3. Accept full responsibility for all activities that occur under your account.

3. Acceptable Use Policy

When using our Service, you agree NOT to:

3. Monitor usage of the Service for compliance with these Terms.
4. Remove any Content from the Service at our sole discretion.

We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.

5. Third-Party Dependencies

Our Service relies on WhatsApp's infrastructure and policies. Consequently:

1. The Service may be affected by changes to WhatsApp's API, terms of service, or functionality.
2. We are not responsible for any restrictions, limitations, or blocking imposed by WhatsApp or Meta Platforms, Inc.
3. You acknowledge that WhatsApp numbers may be banned or restricted by WhatsApp for various reasons, including but not limited to sending too many messages, sending messages to users who have not provided consent, or violating WhatsApp's terms of service.
4. We are not liable for any WhatsApp number bans or restrictions resulting from your use of our Service, regardless of whether such use complied with our Terms.

6. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.

SpreadBee AND ITS AFFILIATES, SUBSIDIARIES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS DO NOT WARRANT THAT:

1. THE SERVICE WILL FUNCTION UNINTERRUPTED, SECURE, OR AVAILABLE AT ANY PARTICULAR TIME OR LOCATION.
2. ANY ERRORS OR DEFECTS WILL BE CORRECTED.
3. THE SERVICE IS FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
4. THE RESULTS OF USING THE SERVICE WILL MEET YOUR REQUIREMENTS.

7. Limitation of Liability

IN NO EVENT SHALL SPREADBEE, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES, BE LIABLE FOR:

1. ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.
2. ANY DAMAGES WHATSOEVER, WHETHER DIRECT OR INDIRECT, IN ALL CASES, ARISING FROM:
   • ERRORS, MISTAKES, OR INACCURACIES IN THE SERVICE OR CONTENT.
   • PERSONAL INJURY OR PROPERTY DAMAGE RESULTING FROM YOUR ACCESS TO OR USE OF THE SERVICE.
   • UNAUTHORIZED ACCESS TO OR USE OF OUR SERVERS AND/OR ANY PERSONAL INFORMATION STORED THEREIN.
   • INTERRUPTION OR CESSATION OF TRANSMISSION TO OR FROM THE SERVICE.
   • BUGS, VIRUSES, TROJAN HORSES, OR THE LIKE THAT MAY BE TRANSMITTED TO OR THROUGH THE SERVICE.
   • LOSS OR DAMAGE OF ANY KIND INCURRED AS A RESULT OF YOUR USE OF ANY CONTENT POSTED, EMAILED, TRANSMITTED, OR OTHERWISE MADE AVAILABLE VIA THE SERVICE.
   • THE DISCLOSURE OF INFORMATION PURSUANT TO THESE TERMS OR OUR PRIVACY POLICY.
   • YOUR FAILURE TO KEEP YOUR PASSWORD OR ACCOUNT DETAILS SECURE AND CONFIDENTIAL.
   • DATA LOSS OR DATA CORRUPTION.
   • BANNING OR BLOCKING OF WHATSAPP NUMBERS.
   • LEGAL CONSEQUENCES ARISING FROM YOUR USE OF THE SERVICE.

THIS LIMITATION OF LIABILITY APPLIES WHETHER THE ALLEGED LIABILITY IS BASED ON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR ANY OTHER BASIS, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGE.

THE FOREGOING LIMITATION OF LIABILITY SHALL APPLY TO THE FULLEST EXTENT PERMITTED BY LAW IN THE APPLICABLE JURISDICTION. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES OR THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATIONS OR EXCLUSIONS MAY NOT APPLY TO YOU.

8. Indemnification

You agree to defend, indemnify, and hold harmless SpreadBee, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:

1. Your violation of these Terms.
2. Your use of the Service, including, but not limited to, any Content submitted or transmitted by you.
3. Any illegal or unauthorized use of the Service.
4. Any violation of WhatsApp's terms of service or other third-party terms.

9. User Data and Privacy

Our collection and use of personal information in connection with the Service is described in our Privacy Policy. By using the Service, you consent to all actions we take with respect to your information consistent with our Privacy Policy.

You acknowledge and agree that:

1. You are solely responsible for obtaining all necessary consents and permissions from recipients before sending them messages through our Service.
2. You will comply with all applicable data protection and privacy laws.
3. We are not responsible for any legal consequences arising from your failure to obtain proper consent or comply with applicable laws.

10. Termination

We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

Upon termination:

1. Your right to use the Service will immediately cease.
2. All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability.
3. We may delete your account and all associated data without liability.

We shall not be liable to you or any third party for any termination of your access to the Service.

11. Governing Law

These Terms shall be governed and construed in accordance with the laws applicable in India, without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.

12. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Service.
